Welcome to the Ahlan mobile e-commerce application ("Application"). These are the terms and conditions (together with the documents referred to herein) that govern the way:

  • you ("Ahlan Members", "you") make online take-out orders for either delivery by Ahlan or the Merchant or collection by you ("Delivery Order" and "Pick-Up Order", respectively, together known as "Online Order(s)") from the selection of Products shown on, and using, the Application;
  • merchants ("Merchants") supply any of their food and beverage products ("Products") listed on the Application to you in fulfillment of your Online Orders; and
  • you receive loyalty rewards earned following the placement and successful fulfillment of an Online Order or in respect of dining in at a Merchant's premises ("Dine-In Order(s)") (Online Order(s) and Dine-In Order(s) together known as an "Order") ("Ahlan Credit").

Please read these terms and conditions carefully before creating an Account or using the Application. By accessing the Application and placing an Online Order you agree to be bound by these terms and conditions and our privacy policy ("Privacy Policy").

If you have any questions relating to these terms and conditions please contact [17434353] before you place an Online Order. If you do not accept these terms and conditions in full please do not use our Application.

If we have to contact you we will do so by telephone or by writing to you at the email address you provided to us with your Online Order and/or Account.

Information about us

The Application is operated by Ahlan Technologies WLL ("we", "us" or "Ahlan"), incorporated and registered in the Kingdom of Bahrain under commercial registration number 138214-1 and whose registered office is at Unit 903 Building 2795 Road 2835 Block 428. Ahlan also performs the physical delivery of Delivery Orders made through the Application.

Our Services

The Application is an online mobile e-commerce loyalty platform that facilitates access between subscribed Merchants and Ahlan Members by providing the means for Ahlan Members to submit Online Orders and allocates and records Ahlan Credit earned on every Order.

We are not involved in any way in the production of any Products.

We do not in any way guarantee the quality of any Products or that any Product complies with applicable laws. Merchants are solely responsible for complying with all applicable laws, rules, regulations, and standards pertaining to food preparation, sale, marketing, packaging and safety and we do not independently verify their compliance.

We do not independently verify the representations, ingredients or the quality of any Products. We cannot guarantee that any of the Online Orders sold by the Merchants are free of allergens (e.g. nut, dairy etc.). Please call the Merchant prior to submitting your Online Order if you have an allergy.

We shall not be liable for any Products offered by Merchant that are unhealthy, the cause of injury, or otherwise do not meet Ahlan Members" expectation in any manner.

Your Account

Before you can place Online Orders using the Application you need to open an Ahlan Application account ("Account"). When you open an Account you may create a password or other secure login method and may have to provide payment card details. You are responsible for keeping your Account username, password, or other secure login method confidential and not disclosing these to any other person. If another person uses these methods to access your Account, you will be liable to pay for any Online Orders they submit, and we are not responsible for any losses you suffer as a result, unless the person using your password obtained it because we did not keep it secure.

You may close your Account at any time by requesting to do so in your Account section of the Site and/or Application or by contacting us using the contact details above. We may suspend your access to your Account, or close it permanently, if we believe that your Account has been used by someone else. We may also close your Account if in our opinion you are abusing the service provided by the Site and/or Application (for example, by applying for refunds or credit to which we do not consider you are entitled, making repeated unreasonable complaints, mistreating our staff, or any other good reason).

Availability

Each Merchant has a prescribed delivery area. This delivery area may change at any time due to factors such as weather, or demand on our service. This is to ensure that Delivery Orders reach you at their best. The Merchants each decide their own operating hours which means that availability of options and the range of Merchants to which you can submit Delivery Orders, depends on the Merchants in your area. If you try to place a Delivery Order for delivery to a location outside the delivery area or operating hours of a Merchant, or the Application is otherwise unavailable for any reason, we will notify that such Delivery Order will not be possible.

Online Orders

Once you have selected your Online Order from the menu of your chosen Merchant you will be given the opportunity to submit your Online Order by clicking on the "Checkout" button. Please check the information that you enter and correct any errors before clicking on the "Checkout" button since once you click on this, errors cannot be corrected.

Once you submit your Online Order, we will send you an email confirming that your Online Order has been received and accepted by the Merchant (the "Confirmation Email").

The contract for the supply of an Online Order using the Application will be between you and the Merchant and will only be formed when you have been sent the Confirmation Email by us.

If we are unable to accept an Online Order, we will inform you of this and you will not be charged for the Online Order.

All Online Orders are subject to availability.

A Merchant may offer an alternative if any part or ingredient required to fulfil an Online Order is not available. Such alternative may be offered after you have received the Confirmation Email. If you do not wish to accept the alternative then you are entitled to cancel the Online Order and you will be refunded the price of the Online Order.

Delivery Orders

Our aim is to provide the best delivery service possible. We will do our best to ensure that your Delivery Order is delivered by the time specified in the Confirmation Email and Application. Delivery time that is showing in the Merchant's logo interface means the average time and is not a fixed time for the delivery. For the avoidance of doubt, the expected delivery time is not a fixed time, it is an approximation. We will notify you of any unforeseen delays.

Delivery will be at the address you provide when you place the Delivery Order. Please ensure that you provide an accurate address and telephone number to ensure that your Delivery Orders arrive to the correct location.

If you need to change the delivery location after you have placed the Delivery Order, we may be able to change the delivery address to an alternative one that is registered with your Account if you inform us prior to the delivery driver being dispatched and the replacement address is within the delivery zone for that Merchant. If we cannot change the delivery address, you have the option to cancel the Delivery Order but you will be charged if the Delivery Order is a Started Order.

If you do not open the door or respond to telephonic correspondence within 10 minutes of our delivery driver physically reaching your provided address, we reserve the right to leave such address and you will be charged for the Delivery Order.

Pick-Up Orders

If you submit a Pick-Up Order you will be required to collect your Pick-Up Order from the Merchant. You will have the option to select the collection time of your Pick-Up Order, which must be at least 30 minutes after the time at which you submitted the Pick-Up Order. You must arrive at the Merchant just before the time for collection stated on the Application and/or in the Confirmation Email. The Merchant will hold your Pick-Up Order for up to 30 minutes after the stated collection time, following which the Merchant may dispose of your Pick-Up Order. You will still be charged for a Pick-Up Order that you fail to collect from the Merchant.

Cancellation and Changes

Ahlan and/or the Merchant may cancel any Online Order, before or after acceptance and will notify you immediately of such cancellation and refund you for the Online Order using the same method you used to pay for your Online Order. All Online Orders paid for by any means other than cash will be refunded within fourteen business days.

A Merchant will classify a Started Order as any Online Order, in respect of which food preparation has begun.

You have the right to cancel or change an Online Order at any time before the Online Order becomes a Started Order. Any Online Order cancelled or changed by you after it becomes a Started Order will be charged to you. Ahlan in its absolute and sole discretion will determine whether an Online Order is deemed a Started Order or not.

You can cancel or change an Online Order by directly contacting the Merchant or by contacting the Application Call Centre on [17434353] or by sending a request through the live chat function on the Application.

Price and payment

The price of any Online Order will be listed on the Application (such prices shall be inclusive of any applicable tax). Prices will vary between Merchants. Prior to confirming your Online Order the final price will be displayed in the Application, which will include the delivery fee if the Online Order is a Delivery Order.

Prices are liable to change at any time, but changes will not affect Online Orders in respect of which you have received the Confirmation Email, save in the case of a pricing mistake, whereby we will notify you as soon as possible. You may be able to cancel your Online Order once we notify you. Despite our best efforts, some of the Products listed on the Application may be incorrectly priced. The relevant Merchant will normally verify prices as part of the Online Order process.

Delivery charges are calculated per Delivery Order and calculated by Ahlan. Any delivery charges or any other fees will be displayed clearly in your Delivery Order summary prior to checkout.

Cash on delivery or collection or credit/debit card payments concluded through the Application can be utilized to make payments for all Online Orders. Once your Online Order has been confirmed payment from your credit or debit card will have been authorized and the amount marked for payment. Payment is made directly to Ahlan and is subsequently passed on by Ahlan to the Merchants.

We are authorized by the Merchants to accept payment on their behalf (both in cash and by electronic payments) and payment of the price of any Online Order by you to us will discharge your obligations to pay such price to the Merchants.

Loyalty points accumulated through Ahlan Credit can be utilized for the payment of Orders by equating it to the denomination in terms of monetary value as detailed in clause 11 (Ahlan Credit).

If the Ahlan Member's bank account currency is different to that in which the prices are listed on the Application, the Ahlan Member's bank will apply their own applicable exchange rate. Ahlan is not responsible for such exchange rates.

Promotions and rewards

Promotions or discounts that may be made available from time to time on the Application are offers that are limited in time and scope and are void where prohibited or restricted by applicable law, rule or regulation. Without limiting the foregoing and in addition thereto, Ahlan reserves the right, in its absolute and sole discretion, to cancel, terminate, modify or suspend any promotions and/or discounts, in each case, in whole or in part, at any time without notice and for any or no reason.

All promotions, discounts and/or rewards detailed above are limited to one (1) Ahlan Member only. All promotions, discounts and/or rewards are non-transferable, may not be resold and may not be combined with any other promotion, discount and/or reward.

Unless otherwise indicated in the additional terms and conditions applicable to any promotion, discount and/or reward or designated by Ahlan from time to time, if there is a minimum purchase requirement any tax, tip, delivery fee and other charges are excluded from the calculation of such minimum purchase requirement.

If a promotion or discount is in the form of a promo code, such code must be entered in the promo code section at checkout in order for it to be redeemed. Without limiting anything set forth in these terms and conditions and in addition thereto, by redeeming a promotion, discount and/or reward, you express your understanding of, and agreement to these terms and conditions and any additional terms and conditions applicable to any promotion, discount and/or reward.

Ahlan Credit

In addition to any promotion or discount that may be made available from time to time, Ahlan Credit rewards a certain percentage ("Credit") from any Order. Your Credit will be stored in your Account by way of redeemable credit, you shall have the right to use your Credit to pay for or towards any Order when and if redemption options are available. Redemption rates may vary at the sole discretion of Ahlan App.

When you sign up to the Application, you will be rewarded for your use of the Application by obtaining Credit.

Each Merchant has a specific credit system for calculating the Credit that will be awarded to you.

Credit shall only be valid for a period of three (3) months from the date on which it was allocated to your Account. Following the expiration of such three (3) month period, the Credit shall expire and shall be removed from your Account and will no longer be redeemable.

Ahlan Members receive several unique benefits through utility of Ahlan Credit such as redemption on bill payment, special offers, promotions, discounts etc.

Any Credit that has been allocated to your Account in respect of a Started Order or an Online Order that is cancelled prior to it becoming a Started Order shall be deleted from your Account upon confirmation that the Online Order has been cancelled.

If your Account is permanently closed for whatever reason, which for the avoidance of doubt includes the cessation of Ahlan's operations, all rewarded and unused Credit stored in your Account will be lost and no monetary value will be attributed to such Credit.

You can keep track of your Credit in the "Ahlan Credit" section of your profile in the Application.

Ahlan reserves the right to terminate, or amend the rights of, the Ahlan Credit loyalty program at any time. If Ahlan terminates Ahlan Credit all rewarded and unused Credit stored in your Account will be lost and no monetary value will be attributed to such Credit.

Missing Item or Partial Cancellation

In case of receiving an Online Order with a missing item, you have the right to ask for a new or replacement item or the amount of the price allocated to the item to be refunded to you in the following ways, when applicable:

  • In case you have made payment for the Online Order by cash and decline a new or replacement item you can either receive a refund of the price of the missing item or the equivalent amount of Credit on the Application;
  • In case you have made payment by credit/debit card, benefit or Ahlan Credit and decline a new or replacement item you will receive an equivalent amount of Ahlan Credit on the Application.

Debit card/Credit Card Details

If you select to save your debit card/ credit card user data, your data will be cached locally in the Application on your device. You may have the option to accept or decline to save your data in this manner. Whenever you update your data, your stored data (if any) will be updated automatically. At any time, you can disable this feature and remove your data through your profile settings.

The debit/credit card information you enter at the time of using the Application service is processed by the payment gateway service provider and is not provided to us. You are solely responsible for the accuracy of the debit/credit card details entered. Where you have selected to save your data as specified above, such selection is entirely at your own risk and you irrevocably waive any rights you may have under any applicable laws, regulations or otherwise, now or in the future to make any claims, demands or take any action against us, our owners, employees, agents, affiliates, or contractors (together the "Releasees") in connection to your data including, without limitation, any claims, demands or actions for any accessing, theft, processing or tampering with the data. You also agree to hold harmless and indemnify each and every one of the Releasees from and against any claims of whatsoever nature and howsoever arising, including legal expenses and costs, which may be made now or in the future against them by you and/or any other party, in connection with any of the matters recited above.

Accessing the Application

Access to the Application is permitted on a temporary basis, and we reserve the right to withdraw or amend access to the Application without notice (see below).

We will not be liable if, for any reason, the Application is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Application, or the entire Application to Ahlan Members. You are responsible for maintaining the confidentiality of your login details and any activities that occur under your Account. If you have any concerns about your login details or think they have been misused, you should contact [ 17434353 ] straight away to let us know. We can deactivate your Account at any time.

Acceptable use

You may use the Application only for lawful purposes. You may not use the Application in any way that breaches any applicable local, national or international laws or regulations, or to send, knowingly receive, upload, download, use or re-use any material which does not comply with clause 17 (Content Standards) below. You also agree not to access without authority, interfere with, damage or disrupt any part of the Application or any network or equipment used in the provision of the Application.

Interactive features

We may from time to time provide certain features, which allow you to interact through the Application or our website (the "Site") such as chat rooms. Generally, we do not moderate any interactive service we provide, although we may remove content in contravention of these terms and conditions. If we do decide to moderate an interactive service, we will make this clear before you use the service and normally provide you with a means of contacting the moderator, should a concern or difficulty arise.

Content standards

These content standards apply to any and all material(s), which you contribute to the Application (the "Contributions"), and to any interactive services associated with it. The standards apply to each part of any Contributions as well as to its whole. Contributions must be accurate (where they state facts), be genuinely held (where they state opinions) and comply with applicable law in the Kingdom of Bahrain and in any country from which they are posted.

Contributions must not:

  • contain any material which is defamatory of any person, obscene, offensive, hateful or inflammatory, promote sexually explicit material or promote violence or promote discrimination based on race, sex, religion, nationality, disability or age;
  • infringe any copyright, database right or trademark of any other person;
  • be likely to deceive any person or be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidentiality or promote any illegal activity;
  • be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety or be likely to harass, upset, embarrass, alarm or annoy any other person;
  • be used to impersonate any person, or to misrepresent your identity or affiliation with any person or give the impression that they emanate from us, if this is not the case; or
  • advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

Suspension and termination

Failure to comply with clause 15 (Acceptable Use) and/or clause 17 (Content Standards) in these terms and conditions constitutes a material breach of the terms and conditions, and may result in our taking all or any of the following actions:

  • immediate, temporary or permanent withdrawal of your right to use the Application;
  • immediate, temporary or permanent removal of any posting or material uploaded by you to the Application;
  • issuing of a warning to you;
  • legal action against you including proceedings for reimbursement of all costs, including, without limitation, administrative and legal costs and expenses, resulting from the breach; or
  • disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

The responses described in this clause are not limited, and we may take any other action we reasonably deem appropriate.

Reliance on information posted

Commentary and other materials posted on the Application are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to the Application, or by anyone who may be informed of any of its contents.

Our right to changes

We may revise these terms and conditions at any time. You are expected to check the Site from time to time to take notice of any changes we make, as they are binding on you.

We aim to update the Site and the Application regularly, and may change the content at any time. If the need arises, we may suspend access to the Site and the Application, or close them indefinitely. Any of the material on the Site or the Application may be out of date at any given time, and we are under no obligation to update such material.

Information about you and your visits to the Site and use of the Application

We collect certain data about you as a result of you using the Site or the Application. This is described in more detail in our Privacy Policy.

Uploading material to the Site and the Application

Any material you upload to the Site or the Application or data that we collect as set out above will be considered non-confidential and non-proprietary, and you acknowledge and agree that we have the right to use, copy, distribute, sell and disclose to third parties any such material or data for any purpose related to our business. To the extent that such material is protected by intellectual property rights, you grant us a perpetual, worldwide, royalty-free license to use, copy, modify, distribute, sell and disclose to third parties any such material or data for any purpose related to our business.

Links from the Site

Where the Site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

Your concerns

Intellectual property rights

The content on the Application and Site, including source code, databases, functionality, software, website designs, audio, video, text, photographs and graphics (the "Ahlan Content"), as well as the trademarks, service marks and logos contained therein (the "Trademarks") are owned by or licensed to Ahlan, and are subject to copyright and other intellectual property rights laws in force in the Kingdom of Bahrain, and other international treaties. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use any Ahlan Content in any way except for your own personal, non-commercial use.

Limitation of liability

To the extent permitted by applicable law, Ahlan provides the Application and content on an "as-is" and "as available" basis and we make no representation or warranty of any kind, express or implied, regarding the content or availability of the Application, or that it will be timely or error-free or that defects will be corrected, or that the site or server that makes it available are free of viruses or other harmful components. Subject to the above, neither Ahlan nor any of its directors, officers, agents, employees or contractor shall have any liability for any direct, indirect, special or consequential losses or damages (including without limitation, damages for loss of business or loss of profits), arising in contract, tort or otherwise from the use or inability to use this site. Nothing in these terms shall exclude or limits liability for death or personal injury resulting from our negligence or that of our agents or employees.

Force Majeure

No party shall be liable or responsible to the other for any delay or non-performance of its obligations under these terms and conditions arising from any cause beyond its control including, without limitation, any of the following: acts of God, war, fire, flood, storm earthquake, governmental acts, breakdown or failure of a utility service or transport or telecommunications network explosion, act of terror, riot, civil commotion,. breakdown of plant or machinery or default of suppliers or sub-contractors.

Indemnity

You agree to indemnify and hold us, our parents, subsidiaries and affiliates, agents, officers, directors, or other employees harmless from any claim, demand, or damage (whether direct, indirect, or consequential), including reasonable attorneys' fees, made by anyone in connection with your use of the Application, your Contributions, any alleged infringement of intellectual property or other right of any person or entity relating to the Application, your violation of these terms and conditions, and any other acts or omissions relating to the Application.

Severability

If any provision of these terms and conditions is judged to be illegal or unenforceable, the continuation in full force and effect of the remainder of the provisions herein shall not be prejudiced.

Entire Agreement

These terms and conditions and the documents referred to herein contain the whole agreement between the parties relating to its subject matter and supersede all prior agreements, arrangements and understandings between the parties relating to its subject matter.

Law and jurisdiction

These terms and conditions and any dispute or claim arising out of, or in connection, with them, their subject matter or formation (including non-contractual disputes or claims) shall be governed by, and construed in accordance with the laws of the Kingdom of Bahrain. The courts of the Kingdom of Bahrain shall have exclusive jurisdiction to settle any dispute or claim arising out of, or in connection with, these terms and conditions, its subject matter or formation (including non-contractual disputes or claims).
